General terms and conditions

  1. General

The Flugplatz [aerodrome] Nordhorn-Lingen GmbH (hereinafter referred to as FNL) charges aerodrome fees according to these tariffs under the following general terms and conditions. Deviating business conditions of the user do not apply, even if the FNL did not contradict them. For aircraft to land, their owners or pilots must pay a fee (landing fee) to the airport operator in accordance with this tariff schedule. If it cannot be determined or it is unclear who is running the craft, the owner becomes the liable payer. The landing fee is calculated according to the maximum take-off weight (MTOW = maximum take-off weight) specified in the certificate of approval for airplanes, rotorcraft, power gliders and self-propelled power gliders. The MTOW is to be verified by the "Airplane Flight Manual (AFM) – Basic Manual-Section for Weight Limitations". Until these documents are submitted the highest known MTOW of this type of aircraft shall be used. No retroactive reimbursements will be made.

 

The following will be accepted as proof of compliance with the noise category of the aircraft:

- the certification and entries in noise certificates in accordance with NfL II - 65/03, issued by an approval authority, or

- labelling in accordance with § 4 (6) of the Landing Field Noise Protection Regulation of 5 January 1999 in accordance with NfL II - 138/99 (environmental protection labels), or

- the submission of corresponding manufacturer data or similar documents and documents of an approval authority which prove the fulfilment of the prerequisites in individual cases.

- ICAO Annex 16, Part II, Chapters 2 and 3 of the bonus list of the BMV as amended.

 

The calculation of the fee is based on the actual presentation of complete and verifiable proof of compliance with the above conditions by the aircraft owner or operator prior to take-off, which must be submitted to air traffic control. Air traffic control is obliged to document this evidence. In the absence of the appropriate proof, the charges shall be calculated on the basis of the noise category C. The final classification into the noise category is carried out by the air traffic inspectorate after inspection of the evidence. No retroactive reimbursements are made.

 

 

  • Fees

"Fees" in terms of this tariff scheme are movement charges, start charges, landing fees, parking fees and anchoring charges. Landing charges are to be paid in euro on the day of landing. The landing fee is consideration within the meaning of section 10 (1) of the [German] Value-Added Tax Act.

 

A movement is either the launch or landing of an aircraft. The landing fee is also payable on ground contact during immediate touch-and-go. For hovering of rotorcraft that exceeds the extent of comparable rolling movements of surface planes, a fee shall be levied at the rate of one landing charge per 10-minute period.

 

  • Parties liable for fees

The following parties are jointly and severally liable in terms of this Fee Schedule Regulation:

  1. The aircraft operator,
  2. The natural or legal person who uses the aircraft, without being the operator or owner,
  3. The carrier conducting the respective flight,The other carriers under whose airline code / flight number the relevant flight is carried out

 

  • Value-added tax

The fees are consideration within the meaning of section 10 (1) of the [German] Value-Added Tax Act. The remuneration or rates specified in this Fee Schedule are net, i.e. business customers resident in Germany must in addition pay Value-Added Tax at the legally applicable rate, unless tax-free sales for aviation are applicable under the legal requirements and these conditions are proved by the business (§§ 4 No. 2, 8 UStG [Value-Added Tax Act]).

 

  • Payment terms

Landing fees are to be paid in euro on the day of landing. FNL invoices must be paid without deductions and within the respective deadlines. Aerodrome charges may be billed to the debtor in agreed billing periods if he provides the agreed amounts for advance payments on the airport charges or a suitable credit guarantee, in particular a personal guarantee or security deposit. FNL is not obliged to pay interest on security deposits in cash nor to keep them separate from their other assets. Insofar as no security agreement exists, the aerodrome fees incurred up to then are due for payment before each departure. The FNL may also charge a fee immediately upon receipt of a delivery or service. The Nordhorn-Lingen airport accepts payment in cash by means of a valid EC card or EC service card.

 

The Flugplatz Nordhorn-Lingen GmbH reserves the right to change fees and scope of services. It will inform debtors in good time. In the event of non-observance of individually agreed payment terms, Nordhorn-Lingen GmbH shall be entitled to charge interest from the date of occurrence of the default of payment, in arrears in the amount of 2% per commenced month up to the amount specified in § 288 (1) BGB [German Civil Code] for the year, if no other arrangement is made in the contract, and to demand cash payment in future. Delay in payment arises no later than 14 days after the invoice has been issued. Offsetting against claims which have not been acknowledged or legally established is excluded.

 

  • Court of jurisdiction and place of performance

Exclusive court of jurisdiction is Nordhorn, insofar as the contractual partner is a merchant, a legal person under public law or a public-law special fund. The Flugplatz Nordhorn-Lingen GmbH is also entitled to sue the contractual partner at their own general court of jurisdiction. The place of performance is Nordhorn. The legal relations between the contractual partner and the Flugplatz Nordhorn-Lingen GmbH are subject exclusively to the law of the Federal Republic of Germany. If a part of these terms and conditions is or becomes invalid, the remaining part is not affected.

 

 

 

 

  1. Landing, take-off, parking and mooring fees

 

 

2.1   Landing fees for propeller planes, rotors, jet planes and power gliders

For each landing at the Nordhorn-Lingen airport, a fee (landing fee) is payable to the aerodrome company.

The aerodrome operator reserves the right to grant the mentioned discounts only if the prescribed noise reduction procedures are adhered to. An indication of this is the evaluations of the aircraft noise measurement system in comparison to the average values ​​of the same or comparable aircraft types.

2.4   Parking fees

For parkining an aircraft on the airfield Nordhorn-Lingen a user fee (parking fee) is payable to the aerodrome operator. If the endurance is not to be determined or unclear, the owner is the debtor. The amount of the parking charges shall be based on the approved maximum take-off weight of the aircraft. The fee must be paid in euros before take off .

A parking fee of no more than 6 hours between landing and take-off of the aircraft will be charged. For the shutdown of aircraft, which is expected to take more than 30 consecutive days, a lease may be concluded between the aircraft keeper and the airport operator before the commencement of the secondment.

 

2.5   Hangar fee

For the submission of an aircraft in different hangars on the airfield Nordhorn-Lingen a monthly fee (Unterstellentgelt) is payable to the airfield company. If the holding is not to be determined or unclear, the owner is the debtor. The amount of the parking charges shall be based on the maximum authorized take-off weight of the aircraft.

2.6   Mooring mast and landing fees for airships

For the use of the airfield with airships an mooring mast fee and a landing fee have to be paid. The mooring mast fee is due with the erection of an anchor mast and is per each 24 hours. The period of time, which is decisive for the calculation of the anchor mast fee, begins with the erection of the mooring mast and ends with its dismantling.

2.8   Special arrangements

In the case of emergency landings due to technical disruption in the aircraft or due to the use of force of violence, no landing / take-off fee shall be payable, unless the airport is already a scheduled destination airport. Deviation landings are not emergency landings.

 

In the case of aircraft operated by an official of an aviation authority of the Federal Republic or State of Lower Saxony in the performance of official duties, no landing / take-off fee shall be payable The same applies to Air Force or police, Border Protection or fire brigade flights or air rescue flights used for that purpose.

 

In addition to the regular landing charge per aircraft and the hour started, the following charges are levied for the check-in (take-off or landing) of aircraft outside the opening hours:

  1. From end of service to 2200 [10 pm] local time and

  1. a) from 0600 [6 am] to start of service: 35.00 euros
  1. b) from 2201 [10:01 pm] to 0559 [5:59 am]: 50.00 euros

 

If several take-offs or landings occur within a period of one hour, the special charge for the aircraft concerned will only be charged once. Irrespective of this, landing fees shall be payable for each landing within this period. At least 2 hours are charged for a separate journey.

 

There is no charge for switching on the landing strip lights during the hours indicated above.

 

2.9   Sundries

The Airport Use Code (FBO), as amended, is an integral part of these terms and conditions.

 

Noise categories „B“, „D“ and „E“ are not used at the Nordhorn-Lingen aerodrome.

 

If a provision of these general conditions does not comply with legal requirements, this provision shall be replaced by the legally permissible provision which comes closest to the intention of the invalid provision. The validity of the remaining provisions shall remain unaffected. The terms and conditions of the contract are subject to the law of the Federal Republic of Germany. The place of performance and court of jurisdiction is Nordhorn.

 

The FNL reserves the right to grant discounts in the case of landing, take-off and hangar fees in individual cases.

 

3.0   Legal validity

The Fee Schedule shall come into force with effect from 1 January 2015. At the same time, the fee schedule of 1 January 2009 shall cease to apply.
